1. General Use of AirVoice Wireless Services
AirVoice Wireless services are provided for personal, non-commercial use only. By using AirVoice services, you agree to:
- Use the services only for lawful purposes;
- Not engage in any illegal, harmful, or abusive behavior;
- Not engage in activities that interfere with or disrupt the normal operation of AirVoice’s services or network.
2. Prohibited Uses
A. Abuse of Service Plans
AirVoice Wireless reserves the right to monitor your usage of our services to ensure compliance with this AUP. We may suspend, terminate, or adjust your service if we determine, in our sole discretion, that your use of the service violates this AUP or constitutes abusive behavior. Examples of prohibited uses include:
- Resale or Commercial Exploitation: You may not resell, re-brand, or commercially exploit AirVoice Wireless services for personal gain.
- Excessive or Non-Personal Use: Using the service for continuous, non-personal purposes such as large-scale file sharing, video streaming, or server hosting. This includes any excessive use of data or voice services that is inconsistent with normal personal use patterns.
- Roaming Abuse: Extended international roaming or roaming in areas outside of AirVoice’s primary coverage area for extended periods, especially if it is outside of your residence or outside the U.S.
- Autodialing Telemarketing and Robocalling: Use of AirVoice Wireless services for automatic dialing, telemarketing (including political, charitable, or commercial solicitation), robocalling or any form of unsolicited bulk communication.
- Unlawfully Identified Calls: Placing calls in which caller identification is improperly altered, including spoofed calling numbers or identities.
- Excessive Call Forwarding or Continuity: Continuous call forwarding or extended mobile-to-mobile call sessions that do not reflect normal personal use.
- Harassment or Offensive Behavior: Using the service to threaten, harass, or abuse others, or to send offensive, abusive, or inappropriate content toward AirVoice Wireless employees, customer service representatives, or any other individual with whom you communicate using the service.
B. Fraudulent or Misleading Conduct
You agree not to engage in any fraudulent or unlawful activity using AirVoice services. Prohibited activities include:
- Fraudulent Transactions: Using AirVoice services for fraudulent financial transactions, chargebacks, or any activities intended to defraud AirVoice or its customers.
- Impersonation and Misrepresentation: Impersonating others, including individuals, businesses, or organizations, or misrepresenting your identity in any manner, including in the process of gaining unauthorized access to services.
3. Unreasonable or Abusive Use of AirVoice Services
AirVoice Wireless will take action, including suspension or termination of services, if your use of our services is deemed unreasonable or abusive. Such use includes, but is not limited to, the following:
- Spamming and Unsolicited Communications
- Voice Spamming: Initiating mass unsolicited voice calls to individuals or systems for commercial, fraudulent, or disruptive purposes.
- SMS Spamming: Sending unsolicited bulk text messages (SMS) to individuals or entities, including commercial spam, advertising, or mass messaging.
- Mass Messaging: Sending mass, unsolicited, or commercial messages using any communication channel provided by AirVoice Wireless, including voice, SMS, or email.
- Excessive or Unauthorized Use of Voice and Data
- Continuous Call Sessions: Using services for long-duration calls, especially those that are not typical for personal use, including persistent or repeated calls to mobile or landline numbers.
- Data Abuse: Excessive use of data for streaming, downloading, uploading, or hosting activities that disrupt network operations or exceed normal personal usage.
- Call Forwarding Abuse: Setting up systems or behaviors that continuously forward calls, particularly those that result in abnormal usage patterns or network congestion.
- Non-Personal Use: Using AirVoice Wireless services in connection with systems that do not involve live, personal interaction between individuals, such as machine-to-machine communication, automatic data feeds, or hosting services.
- Unauthorized or Excessive Roaming
- Roaming Beyond Reasonable Use: Engaging in excessive roaming behavior, especially while traveling outside the U.S. or outside AirVoice’s service areas, including using AirVoice services while residing abroad for long periods.
- Use of Automated Systems or Software
- Autodialing: Using any automated system or device for dialing, including the use of autodialers or auto-answer systems for large-scale communication campaigns.
- Telemarketing: Telemarketing: Using AirVoice services for telemarketing, including unsolicited commercial calls or messages for any form of marketing, solicitation, or sales.
- Misuse of Service for Commercial Purposes
- Traffic Pumping: Engaging in unethical practices such as inflating call volumes to profit from increased intercarrier compensation fees, including using chatlines, conference calling, or international calling arrangements that inflate the number of calls made.
4. International Long-Distance Service
AirVoice’s International Long-Distance Service is provided solely for personal use and should only be used for live dialogue between two individuals. Prohibited uses include:
- Commercial Use: Using the service for resale, conference-call hosting, telemarketing, or any other commercial activities.
- Data Transmission: Using the service for data transmissions, broadcast transmissions, or other non-voice communications.
- Unreasonable Usage: Excessive international calling or activities that do not reflect reasonable, personal use patterns.
If AirVoice Wireless detects misuse, it reserves the right to suspend, terminate, or restrict your service, and you may not be able to reactivate it. For more details, please refer to https://airvoicewireless.com/legal/ild-consumer-agreement.
5. Device Usage
Your AirVoice Wireless device is for personal use only. Prohibited activities include:
- Device Resale: You may not resell, export, or otherwise commercialize the device provided by AirVoice.
- Device Alteration: Altering or tampering with your device in a way that compromises its functionality is prohibited.
- Incompatible Devices: Using devices that are not compatible with AirVoice’s network, including any devices not designed for use with AirVoice Wireless services, is prohibited.
6. Network Integrity and Security
You agree not to engage in activities that compromise the integrity of AirVoice’s network or disrupt service for other users. Prohibited activities include:
- Hacking: Attempting to gain unauthorized access to the network, accounts, or systems of AirVoice Wireless or any third parties.
- Malicious Software: Using or distributing harmful software such as viruses, worms, or malware through the AirVoice network.
- Denial of Service (DoS) Attacks: Engaging in any activity that disrupts, degrades, or overwhelms the AirVoice network, including denial of service attacks or attempts to overwhelm the network with excessive traffic.
7. Lawful Use
You agree to use AirVoice Wireless services only for lawful purposes. Prohibited uses include:
- Illegal Activities: Engaging in unlawful activities such as fraud, theft, or violation of intellectual property rights.
- Harmful Content: Transmitting harmful or offensive content, including child exploitation, harassment, or violations of intellectual property laws.
- Excessive Network Load: Engaging in excessive use that disrupts or degrades AirVoice’s network performance, including unauthorized use for commercial or continuous data transfer activities.
8. Monitoring and Legal Compliance
AirVoice Wireless reserves the right to monitor your use of AirVoice services for compliance with this AUP. If we suspect unlawful activity, we may forward relevant communication and personal information to law enforcement authorities or third parties for investigation and prosecution. We will comply with legal requests, such as subpoenas or court orders, and may be required to provide relevant account data to authorities.
9. No Transfer of Service
You may not transfer or resell your AirVoice Wireless service to another party. This includes providing phone service to others or using your account to offer phone services. AirVoice Wireless also reserves the right to refuse assistance to any individual who is not the verified account holder, regardless of the circumstances, unless required by law.
10. Theft of Device & Service
You are responsible for promptly notifying AirVoice if you suspect that your service or device is being stolen, fraudulently used, or otherwise being used without your authorization. When you notify us of one of these events, you must provide your account number and a detailed description of the circumstances of the theft, fraudulent use, or unauthorized use of Service.
Failure to notify AirVoice promptly may result in continued liability for unauthorized use, and we may disconnect your service until the issue is resolved. Until we receive written notice from you, you will remain liable for all use of your service, including any stolen, fraudulent, or unauthorized use of your service and device, up through the date such notice is received by AirVoice Wireless.
11. Violations and Enforcement
If we determine, in our sole discretion, that you have violated any part of this Acceptable Use Policy, AirVoice Wireless reserves the right to immediately suspend, terminate, or modify your service. All charges incurred prior to termination remain due and payable.
No refunds will be provided for any charges, services, or top-ups associated with service suspensions, terminations, or violations of this policy. Additionally, if your service is suspended or terminated due to misuse or unauthorized activity, you will not be entitled to any refund of previously paid amounts for the affected service period.
